Kansas Supreme Court Upholds Lesbian’s Parental Rights
The Kansas Supreme Court has ruled the non-biological mother of children in a same-sex relationship can have the same parental rights as the biological mother, according to this Wisconsin Gazette article.
The National Association of Social Workers filed a brief in support of Marci Frazier, who had limited visitations with two children she parented with ex-partner Kelly Goudschaal. The two had been in a 13-year relationship and the children are now aged 8 and 10.
The court ruled Frazier’s co-parenting agreement with Goudschaal should be enforced. After the separation, Goudschaal moved the children from Kansas to Texas.
“Children don’t care about biology and sexual orientation,” said Stephanie Goodenow, a lawyer who represented NASW. “They only care about who gives love to them and cares for them.”
